In a case brought by CLCV, represented by Baldon Avocats, the Paris Judicial Court ruled that the claims “carbon neutral”, “100% recyclable” and “100% recycled” displayed on Volvic water bottles and packaging constituted misleading commercial practices.
KEY POINTS FROM THE JUDGMENT 👇
➡️ Carbon neutral: The Court found that carbon neutrality requires greenhouse gas emissions to be fully offset by equivalent removals, which the carbon offsetting mechanisms relied upon did not achieve.
📌 The Court also noted that Directive (EU) 2024/825 of 28 February 2024 now prohibits carbon neutrality claims based on carbon offsetting. According to the Court, this confirms a posteriori the need for caution regarding commercial practices claiming carbon neutrality and for consumers to be provided with complete information in relation to such claims.
➡️ 100% recycled: The Court found this claim to be inaccurate, as certain components, including the cap and label, were not made from recycled materials.
➡️ 100% recyclable: This claim was also found to be misleading, as certain components, including the glue and ink used for the label, were not 100% recyclable.
➡️ Measures ordered by the Court
- Publication of the judgment on the Volvic website homepage for six months
- Compensation awarded to CLCV for the collective harm suffered by consumers
