“Legal questions surrounding the Mercosur agreement” – This article published in the Tagesspiegel Background follows up on the Workshop on the legal compatibility of the EU-Mercosur Partnership Agreement with EU Treaties and commitments, co-hosted by MEP Saskia Bricmont and CAN Europe, in October 2025.

French lawyer Clémentine Baldon, an expert in trade law, criticized the conditions for the protective measures were not clearly defined in the text of the treaty too vague. It must therefore be proven that there are “exceptional circumstances” and “serious damage” to the affected industry. In addition, the measures are very limited in time: they are only to be applicable for two years and only within twelve years of the agreement coming into force.
“The concerns of EU farmers are still very justified,” said Baldon. “The protective measures exist and could be used, but they will not solve the real problem—the expected increase in imports. This is because they will only be temporary and may not be very effective.””
